Description of my issue:I really have no issue. Just curious why version 3.1.10 will not recognize that I have php versions 5.3.and gretaer on both my local site and server site.I back it up on local which is xampp1.7.3 with version 5.3.1 and I have no issue it backs up ok. When I go to reinstall and use the kick start it says that I need version 5.3 or higher I use kickstart 3.3.2. This is when I go to install on server.

This means that your server does not run PHP 5.3, or at least it's not the default PHP version. Please contact your host and ask them to make PHP 5.3 the default PHP version.
