Description of my issue:
I have just installed this site and yesterday I installed 3.7.10. Today I am trying to update to 3.8 but I get the following error:
Error
Downloading the update package failed. Make sure that your temp-directory is writable or that you have enabled Joomla!'s FTP options in your site's Global Configuration.
My tmp directory is set to 0755 and I have never enabled FTP on any of my previous sites but they all seem to work just fine.
Any other advise?

Please try updating manually, by installing the new release without uninstalling the existing one.

That seems to have worked. Two questions. I have updated two of my installations so far and BOTH times I got a backup failed error. I ran the configurator and tried again and the backup appears to be alright. Will this be the morm for this upgrade?
Also, do you have any idea why I had the problem with this update versus normal Akeeba updates?

This is a limitation of the System Restore Points system. Since the default backup directory is inside the component which is being backed up it is exempt from any directory exclusion filters. This is done on purpose because in the other 99% of use cases that's exactly what you want.
